Terms and Conditions of Sale and Use

These General Terms and Conditions govern all contractual relationships between MyNursery SRL (hereinafter "MyNursery" or the "Publisher") and any natural or legal person (hereinafter the "User" or the "Professional Client") accessing the platform or subscribing to its services.

Article 1 – Legal Information & Identification

The platform accessible via www.mynursery.be, mynursery.eu, mynursery.fr, mynursery.lu, and mynursery.nl is published and operated by:

Article 2 – Purpose & Scope

MyNursery is a digital ecosystem and an interactive geolocated portal designed for families and early childhood professionals in Belgium.

  • For Visitors & Families: Accessing the platform, viewing provider listings, using the interactive map, and reading editorial content is 100% free with no registration required.
  • For Professionals & Partners: MyNursery provides geolocated directory visibility, premium promotional advertising spaces, and sponsored editorial article publications.

Article 3 – Fixed-Term Pricing Model & Absence of Subscription

MyNursery operates on a fixed-term package model with no automatic renewal and no direct debits.

  • Non-Commercial Sector (Childcare & Early Education):

    • Beneficiaries: Daycare centres, nurseries, registered/independent childminders, children's homes, in-home nannies.

    • Terms: Creation and hosting of the professional listing 100% FREE for 10 years upon profile approval.

  • Commercial Sector (Retailers & Specialist Services):

    • Beneficiaries: Baby care stores, toy shops, children's apparel stores, specialized service providers.

    • Terms: Fixed annual fee payable upon order (€39.80 incl. VAT / year). Upon expiry of the 12-month period, no automatic renewal takes place.

  • Sponsorship Packages & Nursery News:

    • Visibility options sold individually or as bundled annual packages ("Top 5" Sponsor, "Classic" Sponsor, Duo Pack, Ambassador Pack, or standalone articles).

Article 4 – Orders, Pricing & Payment Terms

  • Orders: All purchases are made online via the designated interface or by written agreement via email (story@mynursery.be or info@mynursery.be).

  • Price Transparency: Prices are stated in euros inclusive of VAT (applicable Belgian 21% VAT) and exclusive of VAT.

  • Accepted Payment Methods:

    • Secure electronic payment (Bancontact, Credit Card).

    • Bank transfer to the official bank account of MyNursery SRL.

  • Due Date: Payment is due immediately upon order validation and is a condition for the activation of services online.

Article 5 – Taxation & Deductibility

As MyNursery is classified as a digital professional advertising directory, expenses incurred by VAT-registered professionals are 100% deductible as business expenses:

  • Full VAT recovery for standard VAT-registered businesses.
  • Net amount tax deduction for self-employed individuals under the small business VAT-exemption scheme.
  • An invoice complying with Belgian legal standards is issued for every commercial transaction.

Article 6 – Publication & Archiving of Articles (Nursery News)

  • Homepage Feature: During the selected duration (7, 14, 21, or 28 days), the sponsored article is prominently featured on the homepage.
  • Permanent Archiving (SEO): At the end of the promotional period, the article is archived in the Nursery News section where it remains permanently accessible at no additional charge.
  • Non-Commercial Content: General interest articles containing no commercial promotion for a for-profit brand or activity are published free of charge.

Article 7 – Right of Withdrawal & Waiver

  • Business-to-Business (B2B) Clients: Pursuant to the Belgian Code of Economic Law, statutory right of withdrawal does not apply to contracts concluded between professionals.
  • Immediate Execution: In the event of a request for immediate online deployment before the expiry of any statutory cooling-off period, the Client expressly waives any right of withdrawal upon commencement of service delivery.

Article 8 – User Obligations & Liability

  • Accuracy of Information: Every professional is solely liable for the accuracy of all data, official accreditations/licences (e.g. ONE, Kind en Gezin), contact details, pricing, and visual assets submitted to MyNursery.
  • Ethics & Legality: The User undertakes not to publish unlawful, defamatory, or non-compliant content regarding child protection standards. MyNursery reserves the right to suspend any non-compliant listing or publication without compensation.

Article 9 – Platform Availability & Technical Liability

  • MyNursery uses all reasonable efforts to ensure 24/7 continuous access to the platform.
  • MyNursery shall not be held liable for temporary interruptions due to maintenance operations, internet service disruptions, hosting downtime, or events of force majeure.

Article 10 – Protection of Personal Data (GDPR)

  • MyNursery SRL processes personal data in strict compliance with the General Data Protection Regulation (GDPR) and the Belgian Law of 30 July 2018.
  • Collected data is strictly used for administrative management, invoicing, and directory listing publication.
  • Under applicable law, every user has the right to access, rectify, port, and delete their data by emailing info@mynursery.be.

Article 11 – Intellectual Property

All components of the platform (the MyNursery ® trademark, logos, graphic design, source code, databases, and general architecture) are protected under intellectual property laws and remain the exclusive property of MyNursery SRL. Any unauthorized reproduction is strictly prohibited.

Article 12 – Amendments, Governing Law & Jurisdiction

  • Modifications: MyNursery SRL reserves the right to update or modify these Terms and Conditions at any time. The applicable version is the one in force on the date of the order.
  • Governing Law: These terms are governed and construed in accordance with Belgian law.
  • Disputes: In the event of any claim or dispute, and failing an amicable resolution, the courts of the judicial district of the registered office of MyNursery SRL shall have exclusive jurisdiction.
