"MyNursery" refers to the website
www.mynursery.beand its associated extensions (.eu,.fr,.lu,.nl), administered and operated by the company MyNursery SRL, whose registered office is established at 4357 Donceel, Rue de Stier 8/3 (Belgium), registered with the Crossroads Bank for Enterprises (CBE) under company number 0780.796.946. -
"Advertiser" refers to any natural or legal person, acting for professional or commercial purposes, who registers on the website, whether free of charge (childcare and family services) or as a purchaser of one or more paid Advertisements/Listings (stores, sponsors).

"Category" represents the family of Advertisers (childcare facilities, in-home nannies, specialized stores, family services, sponsors, etc.). This list is non-exhaustive.

"Publicity" or "Advertisement/Listing" refers to the advertising space and content (contact details, location, descriptions, media) published by the Advertiser on MyNursery to present its activities. The Advertiser bears sole and exclusive liability for all data provided.

"Plan" or "Subscription" refers to the visibility offer (such as the standard 12-month FIDELITY plan), whether free or paid, with or without promotion, selected by the Advertiser at the time of registration or purchase.
Terms and Conditions of Sale
1. Purpose
Any registration of a Listing or any purchase of Publicity on MyNursery implies the full, unreserved, and complete acceptance of these General Terms and Conditions of Sale and Use.
2. Provision of Data and Display
The Advertiser is solely responsible for configuring and entering the data for their Listing via their Pro Dashboard. The Advertiser is expressly informed that Listings are not visible by default: they are only displayed when a visitor performs an active search matching the geographical or thematic criteria of the said Listing.
3. Liability
The Advertisement is published under the sole and exclusive liability of the Advertiser. MyNursery acts strictly as a hosting provider for advertisements and cannot under any circumstances be held liable for the accuracy, non-compliance, lack of freshness, or illegality of the information and services broadcasted by the Advertiser. Advertisers undertake to strictly comply with the laws and regulations in force governing their sector of activity (such as official regional authorizations from Opgroeien, ONE, tax obligations, etc.). MyNursery disclaims all liability for any unlawful acts committed by an Advertiser or for any disputes arising between a visitor and an Advertiser.
4. Right of Refusal and Moderation by MyNursery
MyNursery reserves the discretionary right to refuse, suspend, or remove any Publicity, including during its term, if its content is deemed contrary to the platform's ethics, illegal, misleading, or likely to provoke complaints from third parties or visitors. In the event of a breach, MyNursery will notify the Advertiser by email, stating the grounds for the decision. The Advertiser shall have a period of 48 hours from the sending of this email to modify their Listing. Past this deadline, and without compliant corrective action, the permanently deleted Listing shall not give rise to any recourse or refund.
5. Payment Methods and Recurring Billing
For paid plans (stores, sponsors), MyNursery utilizes an automated, recurring payment system to ensure continuity of visibility and avoid any service interruptions.

Accepted Methods: Credit cards and SEPA Direct Debits.

Management of Renewal: The Advertiser activates recurring billing when placing their order. They retain absolute control over their subscription and can deactivate future payments at any time, free of charge, directly from their Pro Dashboard. Deactivating the renewal stops future charges but does not entitle the Advertiser to any refund for the annual period already underway.

Notice Period: A reminder email is sent to the Advertiser 7 days before the end of their current validity period, reminding them of the automatic renewal or allowing them to remove their payment method to terminate the subscription at the end of the 12 months.
6. Going Online and Activation Timescales

Credit Card: Access to the Pro Dashboard and publication of the Listing are immediate upon validation of the electronic payment (except in the event of third-party technical incidents).

SEPA Direct Debit: Access to the dashboard and activation of the Listing take place after the banking processing time necessary for the confirmation and actual receipt of the funds.

Manual Setup (on Invoice): In the event that an account is created manually by our team upon written or telephone request from the Advertiser, a period of 8 working days following receipt of payment by bank transfer is required for activation. No cash payments are accepted.
7. Category Errors and Adjustments
MyNursery relies strictly on the Category choices validated by the Advertiser. In the event of an obvious registration error (e.g., a store registering improperly in a free category reserved for childcare), MyNursery reserves the right to modify or suspend the Listing. The corresponding financial adjustment (billing of the amount due or issuance of a credit note) will be applied in accordance with the current rates of the actual Category. MyNursery has a technical period of 8 working days to execute the required structural modifications on an active Listing.
8. Subscription Duration
The standard subscription Plan (such as the FIDELITY plan) is concluded for a firm period of 12 continuous calendar months. The date of the electronic payment (or the date of validation of the publication for free plans) shall stand as the start date of the subscription. At the end of the period, if no recurring payment or renewal is validated, the Listing will be deactivated and permanently removed from the public directory within a maximum period of 30 days.
9. Pricing and Invoicing
Rates for paid subscriptions are subject to revision at the end of each quarter. Plans already purchased and paid for remain unchanged until their annual expiry date. Prices on the website are displayed in Euros (€), inclusive of VAT (at the statutory rate of 21%), and are invoiced as such. The paid invoice is made available to the Advertiser in their professional space. Unless voluntary action is taken by the Advertiser to remove their payment method during the 7-day notice period, the subscription is tacitly renewed for a new 12-month period at the current rate.
10. Late Payments and Penalties
For transactions outside the automated system (on invoice), any default or delay in payment on the due date shall, automatically and without prior notice, result in:

The immediate suspension of the contract and the deactivation of all the Advertiser's Listings.

The immediate payment of all remaining sums due.

The application of a fixed and irreducible indemnity of 15% of the sums due by way of a penalty clause, with a minimum of €50.00, without prejudice to the right to claim recovery of any legal and procedural costs.
11. Right of Withdrawal (14-Day Guarantee)
The paying Advertiser benefits from a right of withdrawal of 14 calendar days from the day following the date of the initial purchase of their plan. To exercise this right and obtain a full (100%) refund, the Advertiser must send a clear and unambiguous request by email exclusively to: info@mynursery.be before the expiry of the 14 days. After this period of 14 calendar days, no refund will be granted, as the advertising service is considered fully executed.
12. Service Interruptions and Third-Party Providers
MyNursery endeavors to ensure maximum availability of its platform but depends on a third-party host and technical providers. MyNursery cannot be held liable for temporary service interruptions due to maintenance operations, network failures, cyberattacks, or server overloads. No financial compensation or commercial damage may be claimed by the Advertiser. However, if the total and continuous interruption of the website exceeds 30 consecutive days, the exact duration of the downtime may be credited and added as an extension to the current subscription, upon express request from the Advertiser.
13. Force Majeure
MyNursery cannot be held liable for non-performance or delays in the performance of its obligations in the event of force majeure. In addition to those usually retained by Belgian jurisprudence, the following events are expressly considered as cases of force majeure or fortuitous events: wars, riots, sector strikes, fires, floods, natural disasters, epidemics/pandemics, sabotage, destructive computer viruses, generalized failures of telecommunication networks, or legal restrictions affecting the publisher's activity.
14. Amendments to the GTCS
MyNursery reserves the right to amend these general terms and conditions of sale at any time to adapt them to technical or commercial developments of the site. The new GTCS will apply immediately to new registrations. For Advertisers with an ongoing subscription, if material amendments to the GTCS cause them prejudice, they have the right to terminate their Listing within 14 calendar days following the publication of the new terms, subject to the pro-rata refund or extinction of obligations set out in section 11.
15. Applicable Law and Competent Jurisdiction
The contractual relations between MyNursery SRL and the Advertiser, as well as these GTCS, are exclusively governed by Belgian law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
Any dispute relating to the formation, interpretation, execution, or breach of these terms which cannot be resolved by prior amicable agreement shall fall under the exclusive jurisdiction of the courts of the judicial district of Liège (and, where applicable, the Liège Court of Petty Sessions / Justice de Paix).
